Disclaimer
Helmet disclaimer
All of our helmets are intended only for use in connection with surfing. This is not a bicycle, skateboarding, rock climbing, snowboarding, skiing, paintball, airsoft or other activity helmet. Our helmets are not intended for, and should not be used at construction sites or other sites where there is a risk of objects falling. Surf Skull makes no warranty (express or implied) about the helmet’s safety, effectiveness, durability, or performance outside of surfing. Our helmets have been designed with safety in mind, particularly incorporating a bump cap portion that meets the EN 812:2012 standard. By purchasing or using our helmets, you acknowledge and agree that while the bump cap has been tested to withstand up to 15kN of force in controlled laboratory conditions, real-world situations can be unpredictable and chaotic, and may exceed the safety specifications of the helmet. Users assume all risks associated with the use and misuse of our helmets.
Limitations
Unlike industrial helmets, bump caps are specifically intended to protect the wearer from static objects such as walking into low ceilings or encountering hanging obstructions. Impact tests have been conducted using a 5kg flat striker dropped from a height of 250mm, with a maximum allowable transmitted force of 15kN. These tests simulate scenarios akin to industrial helmet requirements but at a lower energy level. The impacts are carried out on the front and rear of the helmet, with the headform tilted at 30° and 60° to reflect potential real-world impacts. Surf Skull, LLC did not perform these tests; to meet EN 812: 2012 standards we presume they were performed by our suppliers. Surf Skull does not warrant or confirm the representations of such suppliers. Surf Skull is not liable for any damages, including direct, indirect, punitive, incidental, special, or consequential damages, arising out of or connected with the use or misuse of our products, or for helmet failure or damage, injuries, or death that result from impacts that exceed or are not covered by the specification above.
Please exercise judgment and user discretion
Users are strongly advised to exercise judgment and discretion while using this surf helmet. While it is crafted with safety standards in mind, no helmet can guarantee the prevention of all concussions or injuries in every conceivable scenario. Surfing will expose a user to forces that exceed the limits of protection provided by any helmet, and serious injury or death can result from both low and high energy impacts, even when a helmet is worn properly. Real-world conditions may vary, and impacts can differ significantly from controlled laboratory tests. Never use a helmet that has sustained a significant impact or appears to be damaged or cannot be worn or fitted properly.
By using this helmet, you acknowledge and understand the limitations outlined in this disclaimer and hereby indemnify and release Surf Skull from any and all liability arising from any damage, injury, or death incurred in connection with the use or misuse of such helmet. Surf Skull provides no explicit or implicit guarantee regarding the suitability of its helmets for any particular use, nor does it guarantee the degree of protection that such helmets are capable of providing against personal injury, death, or damage to property. User awareness and caution are crucial elements in enhancing safety and enjoyment of any sport, including surfing.
